Cuando una empresa sospecha de una baja que no encaja, la primera petición suele ser siempre la misma: «que le sigan unos días, a ver qué hace». Entiendo la urgencia, pero es justo ahí donde empiezan a torcerse la mayoría de los informes que después no sirven para nada. En una investigación de fraude laboral, lo que determina si un informe se sostiene o no ante un juez ocurre antes de que nadie salga a la calle.When a company suspects a sick leave that doesn't add up, the first request is almost always the same: "follow them for a few days and see what they do." I understand the urgency, but that is precisely where most of the reports that later prove useless begin to go wrong. In a workplace fraud investigation, what decides whether a report will hold up before a judge happens before anyone sets foot on the street.

Lo primero que hacemos al recibir un caso de fraude laboral no es planificar una vigilancia: es escribir una frase. ¿Qué hecho concreto necesitamos acreditar? «Demostrar que finge» no es una frase útil. Sirve algo verificable, del tipo «realiza una actividad incompatible con su situación de baja». La Ley 5/2014 de Seguridad Privada exige que el informe de investigación recoja únicamente información directamente relacionada con el objeto y la finalidad de la investigación contratada, y que ese objeto conste en el propio informe junto con los medios empleados, las actuaciones realizadas y los detectives intervinientes (artículo 49).The first thing we do when we take on a workplace fraud case is not to plan surveillance: it is to write a sentence. What specific fact do we need to prove? "Prove that they are faking it" is not a useful sentence. What works is something verifiable, such as "carries out an activity incompatible with their sick-leave status." Spain's Private Security Act (Law 5/2014) requires the investigation report to include only information directly related to the object and purpose of the engagement, and that this object appear in the report itself, together with the means used, the actions taken and the investigators involved (article 49).

Y un informe difuso es material caro que no prueba nada.In other words: if the object of the engagement is vague, everything gathered afterwards will be vague too. And a vague report is expensive material that proves nothing.

El interés legítimo no es un formalismo de contratoLegitimate interest is not a contractual formality
La misma ley obliga a acreditar el interés legítimo alegado antes de aceptar el encargo y a dejar constancia de ello en el expediente de contratación (artículo 48.2). En el ámbito laboral, ese interés se apoya normalmente en la facultad del empresario de adoptar medidas de vigilancia y control para verificar el cumplimiento de las obligaciones del trabajador, guardando la consideración debida a su dignidad (artículo 20.3 del Estatuto de los Trabajadores).The same law requires the alleged legitimate interest to be established before accepting the engagement and recorded in the contracting file (article 48.2). In the employment context, that interest usually rests on the employer's power to adopt monitoring and control measures to verify that the worker meets their obligations, with due regard for their dignity (article 20.3 of the Workers' Statute).
Conviene un matiz que se confunde a menudo. El Estatuto permite, además, verificar el estado de salud alegado mediante reconocimiento a cargo de personal médico (artículo 20.4). Eso no lo hace un detective. Nosotros no evaluamos diagnósticos ni contradecimos a un facultativo: documentamos conductas observables y dejamos la valoración médica a quien le corresponde.A frequently confused nuance is worth making. The Statute also allows the alleged state of health to be verified through examination by medical staff (article 20.4). That is not something a detective does. We do not assess diagnoses or contradict a doctor: we document observable conduct and leave the medical assessment to those responsible for it.
Sobre si hacen falta indicios previos, la referencia útil es la sentencia del Tribunal Supremo 551/2023, de 12 de septiembre (Sala de lo Social), que admitió el informe de un detective como prueba válida para acreditar incumplimientos laborales y señaló que «la concurrencia de ligeras sospechas, de meros indicios o de indicios relevantes no determina la licitud o ilicitud de la prueba en sí misma considerada». Un apunte honesto: aquel caso se refería a vigilancia durante el tiempo de trabajo, no a una situación de incapacidad temporal, y el propio tribunal apunta que el seguimiento de una persona de baja supone una injerencia potencial mayor. Por eso, en los encargos de fraude laboral dejamos siempre documentado el punto de partida: qué se observó, quién lo observó y por qué se decidió investigar.On whether prior indications are required, the useful reference is Supreme Court judgment 551/2023 of 12 September (Social Chamber), which admitted a detective's report as valid evidence of workplace breaches and stated that "the presence of slight suspicions, mere indications or relevant indications does not in itself determine the lawfulness or unlawfulness of the evidence." An honest caveat: that case concerned surveillance during working hours, not a temporary-disability situation, and the court itself notes that monitoring someone on sick leave entails a greater potential intrusion. That is why, in workplace fraud engagements, we always document the starting point: what was observed, who observed it and why the decision to investigate was made.

Hace un tiempo, un despacho nos pidió empezar el lunes siguiente, con urgencia. Revisamos lo que teníamos y propusimos esperar casi dos semanas, hasta unos días concretos en los que la actividad que sospechábamos tenía sentido que se produjera. Salir antes habría consumido horas de observación sin resultado y, sobre todo, habría alertado al investigado. Una vez que alguien nota que lo están observando, el caso se complica y, muchas veces, se pierde.Some time ago, a law firm asked us to start the following Monday, urgently. We reviewed what we had and proposed waiting almost two weeks, until specific days on which the activity we suspected was likely to occur. Going out earlier would have burned hours of observation with no result and, above all, would have alerted the subject. Once someone notices they are being watched, the case becomes harder and, very often, is lost.

La Ley 5/2014 deja el marco bastante claro. La investigación privada no alcanza a los domicilios ni a los lugares reservados, prohíbe indagar en la vida íntima de las personas y veda emplear medios que atenten contra el honor, la intimidad, la propia imagen, el secreto de las comunicaciones o la protección de datos (artículos 48.1 y 48.3). Y añade algo que en la práctica lo condiciona todo: los servicios deben prestarse con respeto a los principios de razonabilidad, necesidad, idoneidad y proporcionalidad (artículo 48.6).Law 5/2014 sets the framework fairly clearly. Private investigation does not reach homes or reserved places, it prohibits probing into people's private lives, and it bars the use of means that infringe honour, privacy, one's own image, the secrecy of communications or data protection (articles 48.1 and 48.3). And it adds something that, in practice, conditions everything: services must be provided with respect for the principles of reasonableness, necessity, suitability and proportionality (article 48.6).
Esto no es un adorno ético. Es la diferencia entre un buen informe y una carpeta que un juzgado puede desechar entera, arrastrando consigo el material que sí era válido. En casos de fraude laboral, donde la prueba suele ser el único activo del expediente, perderla por exceso es peor que no haber investigado.This is not ethical decoration. It is the difference between a solid report and a file a court can discard in full, dragging down with it the material that was valid. In workplace fraud cases, where the evidence is often the only asset in the file, losing it through excess is worse than not having investigated at all.

El último paso parece menor y es el que sostiene todo lo demás: poder reconstruir después, punto por punto, cómo se obtuvo cada dato. Hora, ubicación, continuidad de la observación, quién estaba allí.The final step seems minor and is the one that holds up everything else: being able to reconstruct afterwards, point by point, how each piece of data was obtained. Time, location, continuity of the observation, who was there.
Ese registro ordenado tiene una razón concreta de ser. Los detectives privados estamos obligados a ratificar el contenido de nuestros informes ante las autoridades judiciales cuando se nos requiere (artículo 37.2.c de la Ley 5/2014). Y la Ley de Enjuiciamiento Civil contempla que la parte contraria pueda interrogar en el juicio al autor del informe sobre los hechos que en él constan. Un informe que no se puede defender oralmente, con detalle y sin contradicciones, no es un informe: es una opinión ilustrada con fotografías.That orderly record exists for a concrete reason. Private detectives are required to ratify the content of our reports before the judicial authorities when called upon (article 37.2.c of Law 5/2014). And the Civil Procedure Act allows the opposing party to question the report's author at trial about the facts it contains. A report that cannot be defended orally, in detail and without contradictions, is not a report: it is an opinion illustrated with photographs.
