Cuando una empresa sospecha de una baja que no encaja, la primera petición suele ser la misma: que le sigan unos días, a ver qué hace. Entiendo la urgencia, pero es ahí donde empiezan a torcerse los informes que después no sirven para nada. Lo que decide si un informe aguantará ocurre antes de que nadie salga a la calle.When a company suspects sick leave that does not add up, the first request is usually the same: follow him for a few days and see what he does. The urgency is understandable, but that is where the reports that later prove useless begin to go wrong. What decides whether a report will hold up happens before anyone goes out.

Definir el hecho que hay que acreditarDefine the fact to be evidenced

Lo primero al recibir un caso no es planificar una vigilancia: es escribir una frase. «Demostrar que finge» no sirve. Sirve algo verificable, del tipo «realiza una actividad incompatible con la limitación funcional que consta en su parte de baja». La diferencia no es de estilo: la Ley 5/2014 de Seguridad Privada exige que el informe recoja únicamente información directamente relacionada con el objeto y la finalidad de la investigación contratada, y que ese objeto conste en el propio informe junto con los medios, las actuaciones y los detectives intervinientes (artículo 49). Si el objeto del encargo es difuso, todo lo que se recoja después será difuso.The first step on a new case is not to plan surveillance: it is to write one sentence. "Prove he is faking" does not work. Something verifiable does, such as "carries out activity incompatible with the functional limitation stated in his medical certificate". The difference is not stylistic: the Private Security Act (Ley 5/2014) requires the report to contain only information directly related to the object and purpose of the investigation contracted, and that this object appear in the report along with the means, the actions and the investigators involved (article 49). If the object of the assignment is vague, everything gathered afterwards will be vague.

El interés legítimo no es un formalismoLegitimate interest is not a formality

La misma ley obliga a acreditar el interés legítimo antes de aceptar el encargo y a dejar constancia en el expediente de contratación (artículo 48.2). En el ámbito laboral ese interés se apoya en la facultad del empresario de adoptar medidas de vigilancia y control para verificar el cumplimiento de las obligaciones del trabajador, con la consideración debida a su dignidad (artículo 20.3 del Estatuto de los Trabajadores). Conviene un matiz que se confunde a menudo: el Estatuto permite además verificar el estado de salud alegado mediante reconocimiento a cargo de personal médico (artículo 20.4), y eso no lo hace un detective. Nosotros documentamos conductas observables y dejamos la valoración médica a quien le corresponde.The same Act requires legitimate interest to be evidenced before accepting the assignment and recorded in the engagement file (article 48.2). In employment matters that interest rests on the employer's power to adopt monitoring and control measures to verify compliance with the employee's obligations, with due regard for their dignity (article 20.3 of the Workers' Statute). One nuance is often confused: the Statute also allows the alleged state of health to be verified through examination by medical staff (article 20.4), and that is not something a private investigator does. We document observable conduct and leave the medical assessment to those qualified to make it.

Lícito no es lo mismo que suficienteLawful is not the same as sufficient

Sobre si hacen falta indicios previos, la referencia útil es la sentencia del Tribunal Supremo 551/2023, de 12 de septiembre (Sala de lo Social, recurso 2261/2022). El tribunal consideró lícita la prueba obtenida por un detective y sostuvo que la existencia de sospechas ligeras, de meros indicios o de indicios relevantes no es lo que determina, por sí sola, la licitud de esa prueba. El final de la sentencia es instructivo: la prueba era lícita y, aun así, el despido se declaró improcedente, al no quedar acreditados los incumplimientos imputados. Licitud y suficiencia son dos exámenes distintos y un informe tiene que aprobar los dos. Añado un matiz: aquel caso trataba de vigilancia durante el tiempo de trabajo, no de una persona en incapacidad temporal, un supuesto que implica una injerencia potencial mayor. Por eso en los encargos de fraude laboral dejamos documentado el punto de partida: qué se observó, quién lo observó y por qué se decidió investigar.On whether prior indications are required, the useful reference is Supreme Court judgment 551/2023 of 12 September (Social Chamber, appeal 2261/2022). The court held the investigator's evidence lawful and stated that the existence of slight suspicions, mere indications or relevant indications is not, in itself, what determines its lawfulness. The ending is instructive: the evidence was lawful and the dismissal was still held unfair, as the alleged breaches were not proven. Lawfulness and sufficiency are separate tests and a report must pass both. One nuance: that case concerned surveillance during working hours, not a person on sick leave, a situation involving greater potential intrusion. That is why in workplace fraud assignments we document the starting point: what was observed, who observed it and why the decision to investigate was taken.

El calendario también forma parte de la pruebaTiming is part of the evidence too

Es la decisión que el cliente rara vez percibe y la que más presupuesto ahorra. Un ejemplo compuesto a partir de varios encargos parecidos: un despacho nos pidió empezar el lunes siguiente, con urgencia. Revisamos lo que teníamos y propusimos esperar casi dos semanas, hasta unos días concretos en los que la actividad que sospechábamos tenía sentido que se produjera. Salir antes habría consumido horas de observación sin resultado y, sobre todo, habría alertado al investigado; una vez que alguien nota que lo están observando, el caso se encarece y muchas veces se pierde. Las horas de vigilancia no son la medida del trabajo: lo son las horas colocadas en el momento en que puede ocurrir el hecho que hay que acreditar.This is the decision clients rarely notice and the one that saves the most budget. An example composed from several similar assignments: a law firm asked us to start the following Monday, urgently. We reviewed what we had and proposed waiting almost two weeks, until specific days on which the activity we suspected was likely to occur. Going out earlier would have consumed hours of observation with no result and, above all, would have alerted the subject; once someone notices they are being watched, the case becomes more expensive and is often lost. Hours of surveillance are not the measure of the work: the measure is hours placed at the moment the fact to be evidenced may occur.

Lo que decidimos no registrarWhat we decide not to record

Hay una parte del oficio que no aparece en ningún informe: todo lo que se decide no grabar. Los servicios de investigación privada no alcanzan a los domicilios, y la ley prohíbe expresamente investigar la vida íntima de las personas que transcurra en sus domicilios u otros lugares reservados, así como emplear medios que atenten contra el honor, la intimidad, la propia imagen, el secreto de las comunicaciones o la protección de datos (artículos 48.1 y 48.3). Y añade algo que en la práctica lo condiciona todo: los servicios deben prestarse con respeto a los principios de razonabilidad, necesidad, idoneidad y proporcionalidad (artículo 48.6). No es un adorno ético. Es la diferencia entre un informe utilizable y una carpeta que un juzgado puede apartar entera, arrastrando el material que sí era válido.There is a part of this work that appears in no report: everything we decide not to record. Private investigation services do not extend to homes, and the law expressly prohibits investigating people's private life taking place in their homes or other reserved places, as well as using means that infringe honour, privacy, one's own image, the secrecy of communications or data protection (articles 48.1 and 48.3). It adds something that governs everything in practice: services must be provided with respect for the principles of reasonableness, necessity, suitability and proportionality (article 48.6). This is not ethical decoration. It is the difference between a usable report and a file a court can set aside in full, dragging down the material that was valid.

Trazabilidad: lo que sostiene el informeTraceability: what holds the report up

El último paso parece menor y sostiene todo lo demás: poder reconstruir después, punto por punto, cómo se obtuvo cada dato. La hora de cada observación y no solo el día, la ubicación concreta y su carácter de espacio de acceso público, la continuidad de la observación incluidos los intervalos en que se perdió de vista al investigado, quién estaba allí y con qué medios, y qué se descartó recoger y por qué. Ese registro tiene una razón de ser: los detectives estamos obligados a ratificar el contenido de nuestros informes ante las autoridades judiciales o policiales cuando se nos requiere (artículo 37.2.c), y la ley procesal civil contempla que la parte contraria pueda interrogar en el juicio al autor del informe sobre los hechos que en él constan. Un informe que no se puede defender oralmente, con detalle y sin contradicciones, no es un informe: es una opinión ilustrada con fotografías.The final step looks minor and holds up everything else: being able to reconstruct afterwards, point by point, how each piece of data was obtained. The time of each observation and not only the date, the specific location and its status as a publicly accessible space, the continuity of the observation including any intervals in which the subject was out of sight, who was there and with what means, and what was ruled out and why. That record exists for a reason: investigators are required to ratify the content of our reports before judicial or police authorities when called upon (article 37.2.c), and civil procedure provides that the opposing party may question the author of the report at trial on the facts it contains. A report that cannot be defended orally, in detail and without contradictions, is not a report: it is an opinion illustrated with photographs.

La diferencia entre una sospecha y un hecho probado casi nunca está en la cámara. Está en haber definido qué se buscaba antes de empezar, en haber elegido bien el momento, en haber dejado fuera todo lo que no tocaba y en poder explicar después cómo se obtuvo cada cosa. El encargo de «que le sigan unos días a ver qué hace» es el que más veces termina en un gasto que no se puede usar. Si hay una decisión laboral en juego, la conversación que importa es la de antes: qué hecho necesita acreditar la empresa y si ese hecho es acreditable dentro de la ley. Ahí se gana o se pierde el informe, mucho antes de que alguien coja una cámara.The difference between a suspicion and a proven fact is almost never in the camera. It is in having defined what was being sought before starting, in having chosen the right moment, in having left out everything that did not belong, and in being able to explain afterwards how each item was obtained. "Follow him for a few days and see what he does" is the assignment that most often ends in money that cannot be used. If an employment decision is at stake, the conversation that matters is the one beforehand: which fact the company needs to evidence, and whether that fact can be evidenced within the law. That is where the report is won or lost, long before anyone picks up a camera.
