Tienes una sentencia firme a tu favor y una cantidad pendiente que no aparece por ningún lado. El deudor, sobre el papel, no tiene nada: ni inmuebles, ni saldo, ni nómina embargable. Y sin embargo su vida sigue igual. Esa distancia entre el patrimonio declarado y el patrimonio real es el terreno donde trabajamos, y también donde más encargos se echan a perder por tomar el atajo equivocado.You hold a final judgment in your favour and an outstanding sum that is nowhere to be found. On paper, the debtor has nothing: no property, no bank balance, no attachable salary. And yet their life carries on unchanged. That gap between declared wealth and real wealth is the ground we work on, and also where most engagements are ruined by taking the wrong shortcut.

Por qué una sentencia firme no garantiza el cobroWhy a final judgment does not guarantee payment

La fase declarativa establece quién tiene razón. La fase de ejecución es otra cosa: hay que señalar bienes concretos sobre los que trabar embargo. Si no se señalan, no hay nada que ejecutar.The declaratory phase establishes who is right. The enforcement phase is another matter: specific assets must be identified against which an attachment can be levied. If none are identified, there is nothing to enforce.

El procedimiento ofrece dos herramientas propias antes de mirar fuera. El artículo 589 de la Ley de Enjuiciamiento Civil permite requerir al ejecutado para que manifieste sus bienes y derechos, con apercibimiento de las sanciones que pueden imponérsele —cuando menos por desobediencia grave— y con la posibilidad de imponerle multas coercitivas periódicas si no responde debidamente. El artículo 590 permite al Letrado de la Administración de Justicia dirigirse a entidades financieras, organismos y registros públicos para investigar el patrimonio del ejecutado.The procedure offers two tools of its own before looking outside. Article 589 of the Civil Procedure Act allows the debtor to be required to declare their assets and rights, under warning of the penalties that may be imposed —at the least for serious disobedience— and with the possibility of recurring coercive fines if they do not respond properly. Article 590 allows the Court Clerk to approach financial institutions, public bodies and registries to investigate the debtor's assets.

Ahora bien, el propio artículo 590 lleva incorporada la frase que explica por qué muchos despachos nos llaman: esa investigación se acuerda a instancia del ejecutante que no pudiere designar bienes suficientes, y no cabe reclamar por esa vía datos que el ejecutante pueda obtener por sí mismo. Dicho de otro modo, el juzgado no sustituye al trabajo previo. Hay que llegar con algo.That said, article 590 itself carries the clause that explains why many law firms call us: this investigation is ordered at the request of the creditor who cannot identify sufficient assets, and it cannot be used to claim data the creditor could obtain themselves. In other words, the court does not replace the prior work. You have to arrive with something.

Qué permite la ley en la localización de bienesWhat the law allows in locating assets

La investigación privada en España tiene un marco escrito. El artículo 48 de la Ley 5/2014 de Seguridad Privada define qué pueden hacer los detectives privados: obtener información y pruebas sobre conductas o hechos privados en el ámbito económico, laboral, mercantil, financiero y social. Eso es exactamente lo que es un encargo de localización de bienes.Private investigation in Spain has a written framework. Article 48 of the Private Security Act (Law 5/2014) defines what private detectives may do: obtain information and evidence about private conduct or facts in the economic, employment, commercial, financial and social spheres. That is exactly what an asset-location engagement is.

Ese mismo artículo impone tres condiciones que en la práctica ordenan todo el trabajo:That same article imposes three conditions that, in practice, govern all the work:

  • El cliente debe acreditar un interés legítimo, del que queda constancia en el expediente de contratación e investigación. Una sentencia firme pendiente de ejecución lo acredita sin discusión.The client must establish a legitimate interest, recorded in the contracting and investigation file. A final judgment pending enforcement establishes it beyond dispute.
  • No se investiga la vida íntima en domicilios ni lugares reservados, ni pueden utilizarse medios que atenten contra el derecho al honor, a la intimidad personal o familiar o a la propia imagen.Private life in homes or reserved places is not investigated, nor may means be used that infringe the right to honour, personal or family privacy, or one's own image.
  • La ejecución del servicio se rige por los principios de razonabilidad, necesidad, idoneidad y proporcionalidad. No es una declaración de intenciones: es el criterio con el que se defiende el informe cuando la otra parte lo ataca.The service is governed by the principles of reasonableness, necessity, suitability and proportionality. This is not a statement of intent: it is the standard by which the report is defended when the opposing party attacks it.

Dónde está el límite: la prueba que se cae y arrastra al restoWhere the limit lies: the evidence that collapses and drags down the rest

Voy a ponerlo con un ejemplo compuesto, de los que se repiten. Un despacho nos plantea un encargo de localización de bienes con una sentencia firme detrás. Trabajo normal. Al cabo de unas semanas llega la petición que cambia la conversación: quieren los movimientos de una cuenta concreta donde sospechan que está el dinero, y alguien menciona un contacto en una entidad bancaria.Let me put it with a composite example, of the kind that recurs. A law firm brings us an asset-location engagement backed by a final judgment. Normal work. A few weeks in comes the request that changes the conversation: they want the movements of a specific account where they suspect the money is, and someone mentions a contact at a bank.

La respuesta es no, y no por escrúpulos. Apoderarse o utilizar sin autorización datos reservados de carácter personal registrados en ficheros o soportes informáticos está tipificado en el artículo 197.2 del Código Penal, con pena de prisión de uno a cuatro años y multa de doce a veinticuatro meses. Ese es el primer problema, y es del investigador.The answer is no, and not out of scruple. Seizing or using, without authorisation, reserved personal data held in files or computer media is an offence under article 197.2 of the Criminal Code, punishable by one to four years' imprisonment and a fine of twelve to twenty-four months. That is the first problem, and it belongs to the investigator.

El segundo problema es del cliente, y suele calcularse mal. El artículo 11.1 de la Ley Orgánica del Poder Judicial es rotundo: «No surtirán efecto las pruebas obtenidas, directa o indirectamente, violentando los derechos o libertades fundamentales». Y el artículo 287 de la Ley de Enjuiciamiento Civil da a la parte contraria el cauce para alegarlo, resolverlo en el propio acto del juicio y, si no prospera, reproducir la impugnación en apelación contra la sentencia definitiva.The second problem is the client's, and it is usually miscalculated. Article 11.1 of the Organic Law of the Judiciary is categorical: "Evidence obtained, directly or indirectly, in breach of fundamental rights or freedoms shall have no effect." And article 287 of the Civil Procedure Act gives the opposing party the means to raise it, resolve it at the trial hearing itself and, if unsuccessful, renew the challenge on appeal against the final judgment.

Fíjate en lo que eso significa en la práctica. La otra parte no discute ese dato aislado: discute al perito, discute el método y discute todo lo demás. Meses de trabajo impecable quedan bajo sospecha por un atajo de cinco minutos. Un informe de protección patrimonial vale exactamente lo que aguanta cuando lo atacan.Consider what that means in practice. The opposing party does not dispute that isolated fact: they dispute the expert, they dispute the method and they dispute everything else. Months of impeccable work fall under suspicion because of a five-minute shortcut. An asset-protection report is worth exactly what it withstands when attacked.

Qué fuentes sostienen un informe de protección patrimonialWhich sources hold up an asset-protection report

La vía lenta es menos espectacular y mucho más difícil de tumbar en sala. Consiste en reconstruir el patrimonio real a partir de fuentes que cualquiera puede verificar después:The slow route is less spectacular and far harder to knock down in the courtroom. It consists of reconstructing the real wealth from sources anyone can verify afterwards:

  • Información registral y mercantil. Titularidades, cargas, fechas de constitución de sociedades, cambios de administrador, aportaciones no dinerarias, cuentas depositadas.Registry and commercial information. Ownership, encumbrances, incorporation dates, changes of director, non-cash contributions, filed accounts.
  • Titularidades cruzadas. Bienes formalmente a nombre de terceros o de sociedades interpuestas, con vínculos familiares o societarios documentables.Cross-ownership. Assets formally held in the name of third parties or interposed companies, with documentable family or corporate ties.
  • Uso efectivo de los bienes. Quién disfruta realmente de un inmueble o de un vehículo, con independencia de quién figure como titular. Esto se acredita con observación en espacios de acceso público, no entrando en ningún sitio.Actual use of assets. Who really enjoys a property or a vehicle, regardless of the registered owner. This is established through observation in publicly accessible spaces, not by entering anywhere.
  • Signos externos de capacidad económica. Actividad profesional efectiva, tren de vida sostenido, presencia pública y digital, que se contrastan con la insolvencia declarada.External signs of economic capacity. Actual professional activity, a sustained lifestyle, public and digital presence, all contrasted with the declared insolvency.
  • Cronología. Cuándo se produjo cada transmisión en relación con las fechas del procedimiento. Esta es, casi siempre, la parte que decide el asunto.Chronology. When each transfer took place in relation to the dates of the proceedings. This is almost always the part that decides the matter.

Ninguna de estas piezas prueba nada por separado. Lo que prueba es el patrón: una secuencia fechada y ordenada que muestra un patrimonio que se vacía mientras el nivel de vida se mantiene intacto.None of these pieces proves anything on its own. What proves it is the pattern: a dated, ordered sequence showing wealth being emptied out while the standard of living stays intact.

Cuando el rastro apunta a un vaciamiento deliberadoWhen the trail points to a deliberate emptying-out

Si el trabajo documenta ese patrón, se abren vías que no dependen de encontrar un saldo escondido. En el terreno civil, el artículo 1111 del Código Civil permite a los acreedores, tras haber perseguido los bienes en posesión del deudor, ejercitar los derechos y acciones de este —salvo los inherentes a su persona— e impugnar los actos que haya realizado en fraude de su derecho. Es la vía revocatoria o pauliana.If the work documents that pattern, avenues open that do not depend on finding a hidden balance. On the civil side, article 1111 of the Civil Code allows creditors, after having pursued the assets in the debtor's possession, to exercise the debtor's rights and actions —except those inherent to their person— and to challenge acts carried out in fraud of their right. This is the revocatory, or Paulian, action.

En el terreno penal, el artículo 257 del Código Penal castiga con prisión de uno a cuatro años y multa de doce a veinticuatro meses a quien se alce con sus bienes en perjuicio de sus acreedores, y también a quien realice actos de disposición patrimonial que dilaten, dificulten o impidan la efectividad de un embargo o de un procedimiento ejecutivo.On the criminal side, article 257 of the Criminal Code punishes, with one to four years' imprisonment and a fine of twelve to twenty-four months, anyone who makes away with their assets to the detriment of their creditors, as well as anyone who carries out acts of disposal that delay, hinder or prevent the effectiveness of an attachment or an enforcement proceeding.

Qué vía conviene, y si conviene alguna, lo decide el abogado con el expediente delante. Mi trabajo no es recomendar una estrategia procesal: es entregar el material fechado y trazable con el que esa decisión se pueda tomar con fundamento.Which route is appropriate, and whether any is, is decided by the lawyer with the file in front of them. My job is not to recommend a procedural strategy: it is to deliver the dated, traceable material on which that decision can be soundly made.

Cómo entra el informe en el procedimientoHow the report enters the proceedings

El informe del detective no es una nota informativa. El artículo 265.1.5.º de la Ley de Enjuiciamiento Civil contempla expresamente los informes elaborados por profesionales de la investigación privada legalmente habilitados sobre hechos relevantes en que las partes apoyen sus pretensiones, y se aportan con la demanda o la contestación.A detective's report is not an informal note. Article 265.1.5 of the Civil Procedure Act expressly provides for reports prepared by legally licensed private-investigation professionals on relevant facts on which the parties base their claims, submitted together with the claim or the defence.

De ahí se deriva lo que más condiciona la forma de trabajar: quien firma el informe tiene que sostenerlo después en sala. Por eso la trazabilidad no es un adorno documental. Hora, ubicación, continuidad de la observación, origen de cada dato, quién estaba allí. Todo lo que no se pueda reconstruir punto por punto ante una pregunta hostil sobra en el informe, por interesante que parezca.From this follows what most shapes the way of working: whoever signs the report has to stand behind it later in the courtroom. That is why traceability is not documentary decoration. Time, location, continuity of the observation, the origin of each piece of data, who was there. Anything that cannot be reconstructed point by point under a hostile question does not belong in the report, however interesting it may seem.

El criterio, resumidoThe criterion, in short

En localización de bienes, la pregunta útil no es «hasta dónde se puede llegar», sino «qué parte de lo que encuentre va a seguir en pie dentro de seis meses». Todo lo que se obtiene fuera del marco legal es material que la otra parte va a usar, no contra ese dato, sino contra el conjunto del informe y contra quien lo firma.In locating assets, the useful question is not "how far can we go," but "which part of what I find will still be standing in six months." Everything obtained outside the legal framework is material the opposing party will use, not against that one fact, but against the report as a whole and against whoever signs it.
